Significant Changes in the Presumption of Innocence in Greece
A public consultation has launched the legislative initiative of the Ministry of Justice, Transparency and Human Rights concerning the incorporation of Directive (EU) 2016/343 to strengthen certain aspects of the presumption of innocence and the right of the defendant to appear in the criminal proceedings.
The Bill contains provisions, such as the possibility of deducting part of the penalty for reparation for the damage caused by the violation of the presumption of innocence by statements of public authorities at any stage of the procedure before the decision was taken.
The purpose of the law is to harmonize Greek legislation with Directive 2016/343, which establishes common minimum rules on: (a) certain aspects of the right to the presumption of innocence in criminal proceedings; (b) the right of the defendant to appear in the trial during the criminal proceedings.
